General Terms and Conditions (GTC) – Meinstream Reseller Edition Vendor Shop

1) Scope
These GTC apply to all contracts for digital software licenses, update packages and services between the seller and consumers or businesses (customer) concluded via the vendor shop at stream.chic-in-style.de/reseller/vendor/shop/.
2) Conclusion of contract
Product descriptions are not binding offers but invitations to submit an offer. The contract is concluded when the seller accepts the offer, in particular by providing the Stripe checkout, receipt of payment and activation of license key/download in the customer account.
3) Digital delivery / no withdrawal after activation
Only digital products are delivered (license keys, download packages, services). No physical shipping.
Before completing the order, the customer expressly agrees that performance of the contract (provision of the license key and digital content) may begin before the withdrawal period expires, and that they thereby lose their right of withdrawal (Sec. 356 para. 5 German Civil Code in conjunction with Sec. 327q BGB for digital content).

4) Prices and payment
All prices are final prices in euros including statutory VAT where shown. Payment via Stripe (card etc.). For update subscriptions, the term is automatically extended upon successful payment for as long as the subscription is active.
5) Licenses and updates
A one-time license entitles the customer to one server installation (single tenant) unless otherwise described. Update entitlements (monthly subscription or one-time packages) extend updates_expire_at of the target license. If a subscription ends or payment is disputed, update entitlement ceases from the documented date; the software already installed remains usable within the scope purchased unless otherwise agreed.
6) Liability disclaimer (software)
The software is provided “as is”. To the extent permitted by law, no warranty is given for uninterrupted operation, freedom from errors or fitness for a particular purpose.
The seller is not liable for: outages, system errors/bugs, overload, misuse, misconfiguration (VPS, domain, SSL, RTMP/HLS, SMTP, Stripe etc.), failures of hosting providers or third parties.
The license may not be duplicated, transferred to third parties, modified or resold. No liability for abusive use or criminal acts in connection with use by the buyer or their end users.
In case of simple negligence, liability is limited to the license fee paid in the last 12 months. Unaffected: intent, gross negligence, life/body/health.
7) Payment disputes / chargebacks
In case of unjustified dispute or chargeback of a payment (Stripe dispute/chargeback), the seller reserves the right to invoice or offset Stripe fees incurred (currently typically approx. EUR 15 per dispute, plus any further bank fees) and reasonable compensation for processing, license suspension and documentation. Already activated licenses may be suspended until clarification.
8) Warranty
Statutory warranty rights apply, limited by the above liability provisions for software and the customer’s infrastructure.
9) Applicable law
German law applies excluding the UN Convention on Contracts for the International Sale of Goods. For consumers with residence in the EU, this applies only insofar as the protection granted is not withdrawn by mandatory law of the state of residence.
